Terms of Service

1. Acceptance of Terms
By accessing or using the Voycee platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Voycee provides voice reception services including automated call answering, appointment scheduling, call routing, transcription, SMS notifications, and workflow automation. The Service is provided on a subscription basis with prepaid wallet-based billing for call usage.
2a. SMS Messaging Consent
By creating a Voycee account and providing your mobile phone number, you consent to receive SMS text messages from Voycee related to your account, including call notifications, account alerts, and service updates. Message frequency varies based on your call volume (typically 1 to 20 messages per week). Message and data rates may apply.
You may opt out at any time by replying STOP to any Voycee message or by disabling SMS notifications in your account settings. Reply HELP for assistance. Consent is not a condition of purchase. See our full SMS Terms & Conditions for details.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.
4. Subscription and Billing
- Subscriptions are billed monthly or annually as selected at signup.
- Calls are billed from your prepaid wallet at actual processing cost plus a service fee. Higher-tier plans receive larger discounts on the service fee.
- Prepaid wallet credits are non-refundable and expire according to the terms of your plan.
- We may change pricing with 30 days' notice. Existing subscriptions are honored through the current billing period.
- Failed payments may result in service suspension after a 7-day grace period.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or to violate any applicable laws
- Transmit spam, robocalls, or unsolicited bulk communications
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Interfere with or disrupt the Service or its infrastructure
- Impersonate any person or entity through the receptionist
- Use the Service to collect sensitive personal data without proper consent

6. Your Data
You retain ownership of all data you provide to the Service, including call recordings, transcripts, and business information. You grant us a limited license to process this data solely to provide and improve the Service. We handle your data in accordance with our Privacy Policy.
Customers requiring a Data Processing Agreement may review our self-serve template at /legal/dpa or request a countersigned copy from privacy@voycee.com. The published subprocessor list identifies the third parties that process your data on our behalf.
7. Healthcare and Protected Health Information
Voycee supports healthcare businesses with a HIPAA-aligned configuration available under a signed Business Associate Agreement (BAA). If your business handles Protected Health Information (PHI), the following applies:
- You must execute a BAA with Voycee before processing any PHI through the Service. Email help@voycee.com with the subject "BAA request" to begin the signing process.
- Until a BAA is executed, you agree not to configure the Service to capture, store, or transmit PHI. Recording-related defaults remain conservative for healthcare tenants while a BAA is pending.
- Voycee will not knowingly process PHI on your behalf without an executed BAA. If you become aware that PHI has been processed without a BAA in place, notify us promptly at security@voycee.com.
8. AI Processing and Disclosure
The Service uses artificial intelligence to answer phone calls, conduct conversations, generate transcripts, and produce summaries. You acknowledge and agree that:
- Every caller receives an AI disclosure at the start of the call, including a notice that the call may be recorded for quality.
- AI outputs (responses, transcripts, summaries, captured fields) are produced by automated systems and may contain errors, omissions, or misinterpretations.
- You will not configure the Service to provide professional advice (legal, medical, financial) or to make binding commitments on behalf of your business beyond appointment booking, lead capture, and routine FAQs.
- You are responsible for reviewing AI-generated content and for escalating calls that require human judgment.
- Voycee may modify the underlying AI vendors, models, or prompts at any time to improve quality or correct defects, without prior notice.
9. Service Limitations
The Service uses voice technology to handle phone calls. You acknowledge and agree that:
- Receptionist responses may not always be accurate, complete, or appropriate for every situation.
- Voycee is not liable for incorrect bookings, misunderstood requests, missed escalations, or any other errors made by the receptionist.
- You are responsible for configuring appropriate escalation rules to route complex or sensitive calls to human staff.
- Callers interacting with your receptionist will be informed that they are speaking with a voice receptionist.
- All calls handled by the Service are recorded and may be transcribed. You are responsible for ensuring this complies with applicable laws in your jurisdiction.
10. Phone Numbers
Phone numbers provisioned through the Service remain the property of the underlying carrier. Upon cancellation, numbers are retained for a 30-day grace period. After the grace period, unretained numbers are released back to the carrier pool.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control, including third-party provider outages.
12. Limitation of Liability
To the maximum extent permitted by law, Voycee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
13. Termination
You may cancel your subscription at any time through the portal. We may suspend or terminate your account for violation of these Terms or non-payment. Upon termination, your data is retained for 30 days before deletion, during which you may request an export.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
